Welcome to Play Well Retreats (“Play Well Retreats,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website (playwellretreats.com), online services, and participation in our retreats, programs, and related activities (collectively, the “Services”).

By accessing or using our website or Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Eligibility

You must be at least 18 years old to use our Services or participate in any retreat. By accessing or booking through our website, you represent that you are legally capable of entering into binding agreements.

2. Bookings and Payments

Reservations

All bookings for retreats, workshops, or programs are subject to availability and confirmation. When you make a reservation, you agree to provide accurate and complete information.

Payments

Payment is due at the time of booking unless otherwise stated. We accept major credit cards and other payment methods as indicated during checkout. By submitting payment, you authorize Play Well Retreats to charge your selected payment method for the total amount due, including applicable taxes or fees.

Pricing and Currency

All prices are listed in U.S. dollars (USD) unless otherwise specified. Prices may change at any time prior to booking confirmation.

3. Cancellations, Refunds, and Credits

We understand that plans may change. Because our retreats require significant planning and advance commitments to partners, the following policies apply:

• Cancellations made more than 90 days before the retreat start date: Full refund minus a 5% administrative fee.
• Cancellations made 60–90 days before retreat start date: 50% refund.
• Cancellations made less than 60 days before retreat start date: No refund (credit may be issued at our discretion).
• No-shows or early departures: No refunds or credits.

If Play Well Retreats cancels or reschedules a retreat due to unforeseen circumstances (e.g., natural disasters, low enrollment, travel restrictions), you will receive a full refund or credit toward a future retreat.

4. Health, Safety, and Personal Responsibility

Our retreats often include physical activities such as yoga, pickleball, hiking, and excursions. By participating, you acknowledge that:

• You are in sufficient health to safely engage in retreat activities.
• You have disclosed any relevant medical conditions, allergies, or limitations.
• You assume all risks associated with participation, including but not limited to injury, illness, or loss of property.

Play Well Retreats and its facilitators are not medical professionals and do not provide medical care. You are advised to consult your physician before engaging in any new wellness or fitness program.

5. Travel and Documentation

Participants are responsible for obtaining valid travel documents, including passports and any required visas or vaccinations. Play Well Retreats is not responsible for delays or cancellations due to missing or invalid travel documents.

Travel Insurance Recommendation

We strongly recommend that all participants purchase comprehensive travel insurance to protect against unforeseen events such as trip cancellations, travel delays, lost luggage, medical emergencies, or other unexpected circumstances that may affect your participation.
Play Well Retreats is not responsible for any financial losses, medical expenses, or other costs incurred due to travel disruptions or cancellations. Your chosen insurance policy should ideally include trip cancellation, trip interruption, and emergency medical coverage.

6. Conduct and Respectful Behavior

We strive to create a safe, inclusive, and respectful environment. You agree to:

• Treat all participants, staff, and local partners with respect.
• Refrain from disruptive, discriminatory, or unsafe behavior.

Play Well Retreats reserves the right to remove any participant whose behavior compromises the well-being or safety of others, without refund.

7. Intellectual Property

All content on our website—including text, images, logos, videos, designs, and course materials—is the intellectual property of Play Well Retreats or its licensors and may not be reproduced, distributed, or used for commercial purposes without our written consent.

8. Limitation of Liability

To the fullest extent permitted by law, Play Well Retreats, its founders, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Use of or inability to use our Services,
• Participation in any retreat or event,
• Acts or omissions of third parties, including accommodations, transportation, or excursion providers.

Our total liability shall not exceed the amount you paid to Play Well Retreats for the specific service in question.

9. Waiver of Claims

By participating in a retreat or event, you release and discharge Play Well Retreats and its representatives from any and all claims, demands, or causes of action arising out of participation, including injury, illness, property damage, or death, except in cases of gross negligence or willful misconduct.

10. Third-Party Services

Our website may contain links to third-party sites or services (e.g., hotels, airlines, wellness practitioners). These are provided for your convenience only. We are not responsible for the content, policies, or performance of third-party websites or vendors.

11. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

12. Force Majeure

Play Well Retreats shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, government actions, strikes, epidemics, or travel restrictions.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the courts of Orange County, California, unless both parties agree to alternative dispute resolution such as mediation or arbitration.

We may revise these Terms from time to time. The most current version will always be available on our website. Your continued use of our Services after changes are posted signifies your acceptance of the updated Terms.

16. Use of Photographs and Media

By participating in a retreat, event, or activity organized by Play Well Retreats, you grant us and our partners the right to capture and use photographs, video recordings, audio, or other media of you taken during the retreat or related events (“Media”).

You agree that Play Well Retreats may use, reproduce, distribute, and publish such Media for promotional, marketing, advertising, or educational purposes in any medium (including social media, websites, print, or digital advertising), worldwide and in perpetuity, without further notice or compensation.

If you prefer not to appear in marketing materials, please notify us in writing before the retreat begins at info@playwellretreats.com, and we will make reasonable efforts to accommodate your request.
